§ 1
Preliminary provisions
Website ambrosia-wesele.pl is run by DAREX Dariusz Pytelewski, Borkowo Kościelne, ul. Kolorowa 5, 09-200 Sierpc, NIP: 776-141-83-43, REGON: 911181893.
These Terms and Conditions are addressed to both Customers and Entrepreneurs using the Website and set out the rules for the use of the Website and the rules and procedures for concluding distance Sales Agreements with the Customer through the Website.
§ 2
Definitions
Customer - any party making a room reservation through the Website.
Consumer - In accordance with Art. 38a. of the Civil Code a natural person not engaged in business activity or a natural person engaged in business activity entering into a contract directly related to his/her business activity, where it is apparent from the content of that contract that it does not have a professional character for that person, arising in particular from the subject matter of his/her business activity made available on the basis of the provisions on the Central Register and Information on Business Activity.
Entrepreneur - a natural person, a legal person and an organisational unit which is not a legal person but to which a separate law grants legal capacity, exercising in its own name an economic activity which uses the Website.
Service - Website operated under the Internet address ambrosia-wesele.pl
Seller - natural person pwho runs a business under the name of DAREX Dariusz Pytelewski entered in the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for economy, NIP: 776-141-83-43
Distance contract - an agreement concluded with the Customer within an organised distance contracting system (within the Service), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the agreement.
Regulations - these Terms of Service.
Account - Customer's account on the Website, where the data provided by the Customer as well as information on his/her Orders on the Website are stored.
Registration form - a form available on the Website for creating an Account.
Order form - an interactive form available on the Website which allows the Order to be placed, in particular by adding Products to the Basket and specifying the terms of the Sales Agreement, including the method of delivery and payment.
Ordering/booking - the service available on the Website which is the subject of the Sales Agreement between the Customer and the Seller.
Sales Contract - Sales Agreement concluded or entered into between the Customer and the Seller via the Website. The Sales Contract is also understood to mean, according to the characteristics of the Product, a service contract and a work contract.
E-MAIL ADDRESSES: respectively e-mail addresses for notifications and declarations of intent, except where these Terms and Conditions provide for written form: for the Customer - the address indicated in the registration form or in the order; for the Seller - kontakt@ambrozja.pl.
BOK - Customer Service available by email at: kontakt@ambrozja.pl and via a contact form from a web-connected device at https://www.ambrozja-wesele.pl/kontakt.
Personal data - information collected as part of the registration form available on the Website under the link https://ambrozja-wesele.pl concerning an identified or identifiable natural person, processed by the Website for the purpose of proper provision of services and other operational and marketing purposes, to which only the data subject has access outside the Administrator.
Working day - one day from Monday to Friday excluding public holidays.
Contact form - a form available on the Website allowing direct contact with the Seller.
Civil Code - Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93 as amended).
Account, profile - Electronic Service, a set of resources and functionalities available in the Service Provider's ICT system, marked by an individual electronic mail address (e-mail address) and a password provided by the Client, in which the data provided by the Client and information about his/her activities on the Website are stored. An Account shall also enable the use of other Electronic Services available on the Site - for which there is a requirement to create an Account beforehand. The account created in the registration process is protected by an individual login and password. An Account and the Customer's login may be assigned to only one Customer.
Newsletter - Electronic Service, an electronic distribution service provided by the Service Provider via e-mail, which enables all Service Recipients who use it to receive automatically from the Service Provider the cyclical content of successive editions of a newsletter containing information about news and promotions on the Website.
Customer panel - a functionality whereby the User, after logging in using the login and password assigned to him/her, can manage his/her Personal Data and use other functionalities available on the Website.
Copyright - Act on Copyright and Related Rights of 4 February 1994 (Journal of Laws No. 24, item 83 as amended).
RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) of 27 April 2016. (Official Journal of the EU L No. 119).
Service, Website - Seller's website available at https://ambrozja-wesele.pl.
Electronic service - service provided electronically by the Seller to the Customer via the Website in accordance with the Terms and Conditions.
Consumer Rights Act, Act - Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827 as amended).
Order - a declaration of intent by the Customer, aimed directly at concluding a sales contract, specifying in particular the number of rooms and the booking period available on the Website.
Price - the amount due from the Customer to the Seller under the concluded sales/reservation contract.
Personal data - any information relating to an identified or identifiable natural person within the meaning of Article 6 of the Data Protection Act.
Internet offer - any offer relating to a given service, managed by the Seller through the ambrozja-wesele.pl website, aimed at concluding a contract between the Customer and the Seller.
Regulation No 1186/2009 - Council Regulation (EC) No 1186/2009 of 16 November 2009 setting up a Community system of reliefs from customs duty (OJ 2009 L 324, p. 23).
Booking - a declaration of intent by the purchaser/principal to rent rooms for a certain period of time.
Sales contract - a contract for the sale of Goods within the meaning of Article 535 of the Civil Code, concluded between the Seller as the seller and the Customer as the buyer.
Data Protection Act - Act of 29 August 1997 on the protection of personal data (i.e. Journal of Laws 2016, item 922, as amended).
Act on Provision of Electronic Services - Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws 2016, item 1030, as amended).
VAT Act - Act of 11 March 2004 on tax on goods and services (i.e. Journal of Laws 2016, item 710, as amended).
Order - a declaration of intent by the Customer to the Seller, containing, in particular, information on the number of rooms and other data enabling the conclusion of a Sales Contract between the Customer and the Seller.

The customer can communicate with the Seller by telephone from 9 am to 5 pm.
§ 4
Technical requirements
In order to use the Website, including viewing the availability of rooms available on the Website and making reservations, you will need:
a terminal device with access to the Internet and a web browser such as Opera, Chrome, Mozilla Firefox, Internet Explorer or a related browser
an active electronic mail (e-mail) account,
cookies enabled,,
FlashPlayer installed.
§ 5
Electronic services on the Website
(1) Any Customer may use the Website under the conditions indicated in the Terms and Conditions. (2) The Customer may use the following Electronic Services on the Website: 2.1 Account (Profile), 2.2 Contact form,
2.3 Newsletter.
ACCOUNT (PROFILE)
(1) The Electronic Account Service is provided for an indefinite period of time and free of charge. 2. (2) The creation and use of an Account is possible after a total of three consecutive steps have been performed by the Customer - (1) filling in the Registration Form, (2) clicking the field "Register" and (3) confirming the wish to create an Account by clicking on the confirmation link automatically sent to the e-mail address provided. In the Registration Form, it is necessary for the Service Recipient to provide the following Service Recipient data: chosen login, first and last name, e-mail address, contact telephone number and password. (3) The Account Electronic Service is provided free of charge for an indefinite period of time. The Client has the possibility, at any time and without giving any reason, to delete the Account (to resign from the Account) by sending an appropriate request to the Service Provider, in particular by e-mail to the address: kontakt@ambrozja.pl
CONTACT FORM
(1) The use of the Contact Form is free of charge. The use of the Contact Form is possible after (1) filling in the contact form and (2) clicking the "Send" field after filling in the contact form. - up to this point it is possible to modify the data entered independently. In the form, it is necessary for the recipient to provide the following data: first and last name, e-mail address, telephone number. (3) The electronic service Contact Form is a one-time service and terminates when the request for contact is sent through it or when the Service Recipient stops using the Contact Form earlier.
NEWSLETTER
(1) The use of the Newsletter is free of charge. 2) Subscribing to the Newsletter is possible by ticking an appropriate checkbox when setting up an Account, sending a request for contact within the Contact Form or staying on the website: ambrozja-wesele.pl 3) The Customer has the possibility, at any time and without giving any reason, to unsubscribe from the Newsletter (Newsletter unsubscribe) by sending an appropriate request to the Service Provider, in particular via e-mail to the address: kontakt@ambrozja.pl or in writing to the following address: Borkowo Kościelne, Ul. Kolorowa 5, 09-200 Sierpc
§ 6
General information
To the fullest extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions in the operation of the Website, caused by force majeure, unauthorised actions of third parties or incompatibility of the Website with the Customer's technical infrastructure.
Viewing room availability on the Website does not require creating an Account. Making a booking by the Customer is possible either after creating an Account or by providing the necessary personal and address information to enable the Order to be processed without creating an Account.
The prices displayed on the Website are in Polish zloty and are gross prices (including VAT).
§ 7
Creating an Account on the Website
To set up an Account on the Website, you must complete the Registration Form. It is necessary to provide the following data: first and last name, exact address, e-mail address, telephone number.
Creating an Account on the Website is free of charge.
Logging into the Account is done by entering the login and password established in the Registration Form.
The Customer may cancel the Account at any time, without stating a reason and without incurring any fees for doing so, by sending an appropriate request to the Seller, in particular by e-mail or in writing to the addresses specified in § 3.
§ 8
General provisions
(1) You must read the provisions of these Terms and Conditions before participating in an online booking. Taking advantage of the online booking means:
a. acceptance of the provisions of the Terms and Conditions;
b. the Customer's consent to the processing of personal data to the extent necessary for the handling and execution of the Order and the exercise of rights and obligations in connection with the concluded or future Sales Contract, in accordance with the Personal Data Protection Act;
The offer is addressed to natural persons performing a legal act not related to the
directly related to their commercial or professional activities and therefore occurring
as a consumer within the meaning of Article 221 of the Civil Code.
(3) All information contained in the Internet Offer, relating to booking rooms (including prices), does not constitute an offer within the meaning of Article 66 of the Civil Code, but an invitation to conclude a contract with the Seller within the meaning of Article 71 of the Civil Code.
4 The conclusion of the Sales Agreement and the effective making of the Booking is possible only if the room selected by the Customer is available. In the event of any discrepancy between the information provided in the content of the Internet Offer and the actual state, the Customer shall be informed thereof and shall have the possibility to amend the booking in whole or in part.
§ 9
Rules for making reservations
(1) The Website makes it possible to book rooms on the Website. By placing an order/reservation, the customer makes an offer to book a specific room under the conditions stated in the room description.
2. the Customer may make an offer to conclude a contract of sale/reservation of a room by selecting a room using the relevant functionality of the Website (by confirming the room reservation).
(3) Reservations for rooms offered on the Website are accepted via the ambrozja-weselewel.pl website.

4.1. via the ambrozja-weseleele.pl website by logging into the Service by clicking on the "LOG IN" link. Orders may be made by Users who have an active Account by placing their selected rooms in the booking summary.
(5) Modification of a booking is only possible by email contact with the BOK: kontakt@ambrozja.pl in the subject line of the message, enter booking modification
7 Making a booking is possible 24 hours a day, on all days of the week.
§ 10
Delivery and payment methods offered
The Customer may use the following methods of delivery or collection of the ordered Product:
Payment by bank transfer to the seller's account
Electronic payments
Payment by credit card.

The service uses a payment system: Przelewy24
4 All booking and room rental prices shown on the respective Internet Offers are in Polish currency and are total prices.
§ 11
Execution of the sales/reservation contract
The conclusion of the Sales/Reservation Agreement between the Customer and the Seller takes place after the Customer places an Order using the Order Form on the Website in accordance with § 7 of the Terms and Conditions.
Once the Order/Reservation has been placed, the Seller immediately confirms its receipt. Confirmation of receipt of the Order/Reservation and its acceptance for execution is made by the Seller sending the Client a relevant e-mail message to the Client's e-mail address provided during the placement of the Order, which contains at least the Seller's statements about receipt of the Order. As soon as the Customer receives the above email, the Sales Contract between the Customer and the Seller is concluded.
Booking payments available:
- When paying by bank transfer using Przelewy 24 - payment for the entire stay (100 %)
by transfer via the Przelewy 24 service
- Reservations will be confirmed upon payment
§ 12
Right of withdrawal
The consumer may withdraw from the Sales Contract within 14 days without giving any reason.
Sole traders, i.e. entrepreneurs entered in the Central Register and Information on Business Activity (CEIDG), who conclude contracts (including sales contracts on the Online Services) that are not professional in nature for them, have the right to withdraw from the contract within 14 days.
The period referred to in paragraph 1 shall start to run from the delivery of the Product to the Consumer or to a person designated by the Consumer other than the carrier.
The Consumer may withdraw from the Contract by making a statement of withdrawal from the Contract to the Seller. It is sufficient for the Consumer to send the declaration before the deadline for withdrawal from the Contract to be observed.
The statement may be sent by traditional mail, fax or electronically by sending the statement to the Seller's e-mail address or by submitting the statement on the Seller's website - the Seller's contact details are specified in § 3. The statement may also be submitted on a form, the template of which is attached as Appendix No. 1 to these Regulations and Appendix to the Act of 30 May 2014 on Consumer Rights, but this is not obligatory.

(6) Where the Consumer sends a statement electronically,
The Seller shall immediately send to the Consumer at the address specified by the Consumer
e-mail address to confirm receipt of the notice of withdrawal.
7 Consequences of withdrawal from the Agreement:
In the event of withdrawal from a Distance Contract, the Contract shall be deemed not to have been concluded.
In the event of withdrawal from the Agreement, the Seller shall reimburse to the Consumer immediately, no later than within 14 days of receipt of the Consumer's declaration of withdrawal from the Agreement, all payments made by the Consumer, including the costs of delivery of the item, except for the additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller.
The Seller shall refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not incur any costs for the Consumer.
The Seller may withhold reimbursement until it has received the Product back or until it has been provided with proof of return, whichever event occurs first.
The Consumer should send back the Product to the Seller's address given in these Terms and Conditions immediately, no later than 14 days from the day on which the Consumer informed the Seller about the withdrawal from the Contract. The deadline shall be met if the Consumer sends back the Product before the expiry of the 14-day period.
The consumer shall bear the direct costs of returning the Product, including the costs of returning the Product if, due to its nature, the Product could not be returned by post in the usual manner.
The consumer shall only be liable for any diminution in the value of the Product resulting from the use of the Product other than what was necessary to establish the nature, characteristics and functioning of the Product.
(9) Where, due to the nature of the Product, it cannot be sent back in the usual way by post, information about this, as well as about the costs of returning the Product, will be included in the description of the Product on the Website.
(10) The right of withdrawal from a distance contract shall not apply to the Consumer in respect of the Contract:
where the object of the performance is a non-refabricated item manufactured to the Consumer's specifications or to meet the Consumer's personalised needs,
where the object of the service is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons if the packaging has been opened after delivery,
in which the object of the performance is a perishable object or an object with a short shelf life,
for the provision of services, if the Seller has performed the service in full with the express consent of the Consumer, who has been informed before the performance of the service by the Seller that after the Seller's performance he will lose his right of withdrawal,
in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the end of the withdrawal period,
in which the subject matter of the performance consists of items which are, by their nature, inseparable from other items after delivery,
in which the object of performance is alcoholic beverages, the price of which has been agreed upon at the conclusion of the sales contract, the delivery of which may only take place after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control,
in which the subject matter of the service is sound or visual recordings or computer programs supplied in sealed packaging if the packaging is opened after delivery,
for the supply of newspapers, periodicals or magazines, with the exception of a subscription contract,
for the supply of digital content which is not recorded on a tangible medium if the performance has begun with the consumer's express consent before the end of the withdrawal period and after the Seller has informed the consumer of the loss of the right of withdrawal
For bookings:
- Refunds/cancellations can be made up to 4 days before the stay and the total deposit will then be refunded.
- In the event of cancellation after the deadline, i.e. less than 4 days prior to the booking date, no refund will be made by the vendor.
§ 13
Complaint and warranty
1. A complaint should be made in writing or by e-mail to the address given in this
Regulations the Seller's addresses.
The Seller shall respond to the complaint request immediately, but no later than
than within 14 days, and if it fails to do so within that period, it shall be deemed that the request
The client considered it justified.
3. Complaints arising from violations of the Customer's rights guaranteed by law
should be addressed to e-Seller's e-mail. The seller undertakes to
to assist the Customer free of charge in forwarding the complaint to the Seller.
Complaints are dealt with within the time limits imposed by the relevant legislation.
The entitlement referred to in § 7.1 of the Terms and Conditions shall apply to Sales Agreements
concluded by the Customer with a Supplier established in an EU State. To Contracts
sales concluded by the Customer with a Supplier established in a third country
the provisions of the law applicable to the Seller's registered office shall apply, which may be
differ from the regulations in force in the EU countries.
Complaints about the provision of electronic services
1. the Seller shall take steps to ensure the correct operation of each Offer
Internet, to the extent that this is based on current technical knowledge, and undertakes to
rectify within a reasonable time any irregularities reported by customers.
(2) The Customer shall immediately notify any irregularities or interruptions in the operation of the relevant Online Offer.
(3) In the complaint, the customer should state his/her name, mailing address, type and date of the irregularity.
4 The Seller undertakes to process each complaint within 14 (in words:
fourteen) days or, if this is not possible, to inform you before the expiry of that period
The customer when the complaint is resolved.
§ 14
Out-of-court complaint and redress procedures
Detailed information on the consumer's possibilities of using out-of-court complaint and redress procedures and the rules of access to these procedures are available at the offices and websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection and at the following internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
The consumer has the following examples of out-of-court complaint and redress procedures:
The consumer shall be entitled to apply to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) to resolve a dispute arising from the Agreement concluded with the Seller.
The Consumer shall be entitled to apply to the provincial inspector of the Trade Inspection, pursuant to Article 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), to initiate mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller.
A consumer may obtain free assistance in resolving a dispute between him and the seller, also using the free assistance of a county (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Association of Polish Consumers).
§ 15
Personal data on the Website
The administrator of the Customers' personal data collected via the Website is the Seller.
Customers' personal data collected by the administrator via the Website are collected for the purpose of fulfilling the Sales Agreement and, if the Customer agrees, also for marketing purposes.
Recipients of the personal data of the Customers of the Website may be:
In the case of a Customer who uses the postal or courier delivery method on the Website, the Administrator makes the collected personal data of the Customer available to the selected carrier or intermediary performing the delivery on behalf of the Administrator.
In the case of a Customer who uses the electronic or credit card payment method on the Website, the Administrator shall make the collected personal data of the Customer available to the selected entity handling the aforementioned payments on the Website.
4 The customer has the right to access and correct their data.
5. provision of personal data is voluntary, although failure to provide the personal data specified in the Terms and Conditions necessary to conclude a Sales Agreement results in the inability to conclude the Sales Agreement.
§ 16
Copyright
Copyrights and intellectual property rights to the Website as a whole and its individual elements, including content, graphics, works, designs and signs available as part of the Website belong to the Seller or other authorised third parties and are protected by the Copyright Law and other generally applicable laws. The protection granted to the Website shall extend to all forms of their expression.
2 The Service Provider's trademarks and those of third parties should be used in accordance with the applicable legal provisions.
§ 17
Final provisions
(1) Contracts concluded through the Website shall be concluded in the Polish language.
The Seller reserves the right to make changes to these Terms and Conditions for important reasons, i.e.: change of legal regulations, change of payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller shall inform the Customer about each change at least 7 days in advance.
(3) Matters not covered by these Terms and Conditions shall be governed by generally applicable provisions of Polish law, in particular: Civil Code; Act on Providing Services by Electronic Means; Act on Consumer Rights, Act on Personal Data Protection.
(4) The customer has the right to make use of out-of-court complaint and redress procedures. To this end, he may submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
(5) Any disputes relating to the Sales Agreement shall be settled by the competent Polish common courts.

Annexes
